Terms of Service

These Terms of Service ("Terms") govern your use of TopVirtualAssistants.com (the "Platform"), operated by TopVA ("TopVA", "we", "us"). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. Who can use the Platform

You must be at least 18 years old and able to enter into a binding agreement. The Platform has two kinds of users:

• Job seekers: virtual assistants who create a profile and apply to jobs.
• Employers: businesses that post jobs and review candidates.

2. Your account

You must give accurate information and keep it up to date. You are responsible for keeping your password secure and for everything that happens under your account. Tell us promptly if you think your account has been compromised. One person or business per account; don't create accounts on someone else's behalf without their permission.

3. Job seekers

• Your profile (including your work history, skills, rate, availability and, if you record one, your intro video) is visible to employers on the Platform.
• You confirm that what you submit — resume, profile details, video — is truthful and your own.
• We may ask you to verify your identity before your profile is activated or shown to employers.
• Recording an intro video is optional. If you record one, it is processed as described in our Privacy Policy, and you can ask us to delete it at any time.

4. Employers

• Job posts must describe real roles accurately, comply with applicable law, and must not discriminate on the basis of age, sex, religion, ethnicity, disability, marital status or any other protected characteristic.
• You may use candidate information only to evaluate and contact candidates for roles you posted on the Platform. You may not copy, export, sell or reuse it for any other purpose.
• You are responsible for your own hiring decisions and for complying with employment and data protection laws that apply to you.

5. AI features

The Platform uses artificial intelligence to help fill in profiles from uploaded resumes, estimate how well candidates match jobs, explain those matches, and assess intro videos for spoken English clarity. These outputs are advisory: they can be wrong or incomplete, they never reject anyone automatically, and hiring decisions are made by people. Employers should not rely on an AI output as the sole reason for a hiring decision. See "How we use AI" in our Privacy Policy for details.

6. TopVA's role

TopVA provides the Platform that connects job seekers and employers. We don't guarantee that any job seeker will be hired or that any employer will find a candidate.

7. Acceptable use

You agree not to:

• post false, misleading, or unlawful content, or impersonate anyone;
• scrape, crawl, or bulk-download data from the Platform, or use bots to create accounts or applications;
• try to access accounts or data that aren't yours, or interfere with the Platform's security or operation;
• use the Platform to send spam, solicit payments from job seekers, or run scams;
• upload malware or content that infringes someone else's rights.

8. Your content

You keep ownership of what you upload. You give TopVA a non-exclusive, worldwide, royalty-free licence to host, process, display and share that content as needed to run the Platform — for example, showing your profile to employers or processing your resume to fill in your profile. This licence ends when your content is deleted, except where we must keep it by law.

9. Suspension and termination

You can stop using the Platform and ask us to delete your account at any time. We may suspend or close accounts that break these Terms, put other users at risk, or that we're required to close by law. Where reasonable, we'll tell you why.

10. Disclaimers

The Platform is provided "as is" and "as available". To the extent the law allows, we make no warranties about the accuracy of job posts, candidate profiles or AI outputs, or that the Platform will be uninterrupted or error-free. We don't verify every statement users make.

11. Limitation of liability

To the extent the law allows, TopVA is not liable for indirect, incidental or consequential losses, or for loss of profits, data or opportunities, arising from your use of the Platform or from dealings between job seekers and employers. Nothing in these Terms limits liability that cannot be limited by law.

12. Changes to these Terms

We may update these Terms. We'll change the "Last updated" date above and, for material changes, notify you by email or on the Platform. Continuing to use the Platform after a change means you accept the updated Terms.
